5. SMS/TEXT MESSAGING AND MOBILE INFORMATION
5.1 Collection of Mobile Information
When you opt in to receive SMS or text messages from Pool Runs, we may collect your mobile phone number, your consent to receive messages, and information about your messaging preferences.
5.2 Use of Mobile Information
We may use your mobile phone number to send you SMS or text messages related to:
- Account notifications and alerts
- Service updates and reminders
- Appointment confirmations and scheduling
- Billing and payment reminders
- Promotional offers and marketing communications (with your express consent)
5.3 Protection of Mobile Information
Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We may share your mobile information only with service providers who assist us in delivering SMS messages (such as our messaging platform provider), and these providers are contractually prohibited from using your information for any purpose other than delivering messages on our behalf.
5.4 Opt-Out
You may opt out of receiving SMS or text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a final confirmation message, and no further messages will be sent unless you re-subscribe. You may also contact us at [email protected] to opt out.
5.5 Message Frequency and Rates
Message frequency varies based on your account activity and preferences. Message and data rates may apply depending on your mobile carrier and plan. Pool Runs is not responsible for any charges incurred from your mobile carrier.
6. LEAD GENERATION AND SKIP TRACING DATA
6.1 How Skip Tracing Works
Our Lead Generation Services use third-party data providers to obtain contact information and property data ("Skip Tracing Data"). When you use these features:
- We may share limited information (such as geographic areas or property addresses) with data providers to obtain matching records
- Skip Tracing Data is provided to you through the Service
- We do not independently verify the accuracy of Skip Tracing Data
6.2 Your Responsibilities
As outlined in our Terms of Service, you are solely responsible for:
- Your use of Skip Tracing Data
- Complying with all applicable laws (including TCPA, FCRA, CAN-SPAM, and Do-Not-Call regulations)
- Obtaining any necessary consents before contacting individuals
6.3 Skip Tracing Data is Not a Consumer Report
Skip Tracing Data provided through our Service is NOT a consumer report under the Fair Credit Reporting Act (FCRA) and may not be used for credit, employment, insurance, housing, or other FCRA-regulated purposes.
7. DATA RETENTION
We retain your information for as long as your Account is active or as needed to provide you with the Service. We may also retain and use your information as necessary to:
- Comply with legal obligations
- Resolve disputes
- Enforce our agreements
- Protect our legal rights
When you close your Account, we will delete or anonymize your information within a reasonable timeframe, unless we are required to retain it for legal or legitimate business purposes.
Customer Data: Upon Account termination, we may retain Customer Data for up to 90 days before deletion to allow for Account recovery or data export. After this period, Customer Data will be permanently deleted.
